Mid-County Refinery Storage, Distribution Facility Fined by State

May 26, 2023 [Beaumont Enterprise]- Energy Transfer’s Nederland terminal has been fined by a state agency for illegally releasing oil, grease and “suspended solids” into nearby water.

 

On May 9, the Energy Transfer Nederland Terminal was fined $29,400 by the Texas Commission on Environmental Quality.

The Nederland terminal, located at 2300 North City Highway, provides storage and distribution services for refiners and other large transporters of crude oil and natural gas liquids, according to Energy Transfer.

Texas Commission on Environmental Quality documents say that the company failed to comply with the effluent limitations for oil and grease and total suspended solids.”

“Effluent limitation means any restriction established by (an) administrator on quantities, rates, and concentrations of chemical, physical, biological and other constituents which are discharged from point sources, other than new sources, into navigable waters, the waters of the contiguous zone or the ocean,” Cornell University’s Legal Information Institute states.

In addition to the fine, the company has to submit written certification of compliance with the permitted effluent limitation within 130 days. The written certification should include specific corrective actions the facility implemented to achieve compliance. It should also include copies of the terminal’s most current self-reported discharge monitoring reports that demonstrate at least three consecutive months of compliance with all permitted effluent limitation as well as photographs, receipts and other records that demonstrate compliance, the documents state.

“Human health or the environment has been exposed to insignificant amounts of pollutants that do not exceed levels that are protective of human health or environmental receptors as a result of the violation,” Texas Commission on Environmental Quality documents state.

The Energy Transfer Nederland Terminal is one of 18 entities fined May 9 for a total of $38,127.
